WAIVER & RELEASE
You, the undersigned, have registered to participate in an event, class, retreat, workshop, or other offering hosted by The Collective Om LLC (“we” or “our”) (the “Event”). If you do not sign this Waiver and agree to its terms, you will not be allowed to participate in the Event. If you bring a minor to the Event, you are also agreeing to the terms of this Waiver on their behalf.
1. Assumption of Risk. You understand that you are responsible for yourself and your safety at all times. You understand that the Event may include physical, wellness, recreational, and outdoor activities, including but not limited to yoga, reiki, yoga nidra, meditation, breathwork, sound healing, walking or hiking, kayaking, paddleboarding, swimming or water-based activities, dance, and other movement, wellness, recreational, outdoor activities. You understand that you are responsible for any and all risks related to participating in the Event and the environment in which the Event takes place, including but not limited to uneven or natural terrain, stairs, weather conditions, water, wildlife, outdoor environments, and other conditions of the premises. If you elect to participate in certain Event activities, you assume all related risks, including any potential emotional strain related to a physical activity.
2. No Medical Advice. You understand that the information provided during the Event is general in nature and not specific to any one individual. You should not consider any information provided to be medical advice. If you have questions or concerns, please contact your medical provider.
3. Use of Likeness. By attending the Event, you grant us the right to record, film, photograph, or capture your likeness in any media. Additionally, you agree to our future royalty-free use of this content for any purpose, including advertising and marketing, which may include your likeness. You understand that this means we may use video or photos of the Event for promotional purposes.
4. Prohibited Conduct. You agree not to engage in any disruptive conduct. We reserve the right, in our sole discretion, to remove you from the Event if we determine that you have engaged in any prohibited conduct.
5. Release, Waiver, and Indemnity. You, on behalf of yourself, your family, heirs, executors, or anyone else who may be able to bring a legal action on your behalf, hereby release, hold harmless, indemnify, and waive any claims against us, our members, directors, officers, contractors, employees, volunteers, agents, executors, administrators, successors, family members, and assigns (the “Released Parties”) from any liability and damages arising from death or personal injuries, including the contraction of any contagious viruses/diseases or related to premises liability, however caused, including as a result of our negligence, during your participation in the Event. You agree to forfeit any and all forms of legal recourse which may be available to you, including but not limited to any form of damages or legal cause of action, as a result of your participation in the Event.
6. General Legal Provisions. This Waiver will be governed exclusively by the laws of the State of Florida. The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts of the State of Florida. If any provisions of this Waiver are invalid or unenforceable, the other provisions in the Waiver will remain in full force and effect.
By agreeing to this Waiver, you agree that you a) have read the Waiver b) have been fully and completely advised of the potential dangers incidental related to the Event, c) are electing to waive certain legal rights, d) and are fully aware of the legal consequences of signing this Waiver and e) are agreeing that your electronic signature is valid and voluntary.
